Nebraska REALTORS® Association (NRA), a 501c6 organization, was founded in 1917. NRA provides professional standards, education, & advocacy to our 5400 REALTORS® in Nebraska. The mission of NRA is to play a vital role in keeping REALTOR® firms and associates in a successful business environment and to become the true voice for real estate in Nebraska by promoting the extension and preservation of the right to own, use and transfer real property without undue regulatory restraint. We are searching for contracted General Counsel and Legal Hotline Counsel to assist the members our Association with the following responsibilities:
EXPECTED RESPONSIBILITIES AS GENERAL COUNSEL:
- Be available for inquiry on State Association matters or statewide issues by the current NRA President, Chief Executive Officer and staff designated by the CEO.
- Review, revise and/or prepare NRA Standard Forms, contracts and clauses as needed.
- Attend all NRA Board of Director meetings, facilitate as parliamentarian and review all minutes of the Board of Directors meetings.
- Review and recommend proposed amendments to NRA Bylaws as required.
- Review minutes of NRA Executive Committee meetings and other meeting minutes and documents as forwarded from the Chief Executive Officer.
- Provide a "Legal Review" for the Nebraska REALTOR® News & Notes regarding changes or issues affecting the real estate industry or REALTORS®.
- Provide legal defense as necessary, at a cost to be determined with the NRA Executive Committee.
- Attend Committee meetings as requested.
- Provide advice on legislative matters as requested.
- Be available to attend legal briefings and educational seminars conducted by the National Association of REALTORS®.
- Review contracts and leases (i.e., Chief Executive Officer, Office, Third-Party Vendors) when necessary.
- Must be familiar with the following areas of law: Association, Anti-Trust, Corporation, MLS Policy, Real Estate.
EXPECTED RESPONSIBILITIES FOR LEGAL HOTLINE
- To answer all Hotline questions at the time of the call, if possible, otherwise within 24 hours if additional research is necessary.
- To maintain the hours of the Hotline as follows: Monday through Friday, 10:00 a.m. to 12:00 p.m. and 2:00 p.m. to 4:00 p.m.
- To provide a follow up letter to the Hotline caller within 48 hours of your answer, and to provide the Nebraska REALTORS® Association with a copy of the follow up letters on a monthly basis in an electronic format.
- To categorize the Hotline calls into topical groupings, and identify the topic on the follow up letter of each call, for example Agency, Disclosure, Environmental Hazards, etc.
- To retain a word processing back up of each follow up letter, and make these files available to the Association upon our request. These will occasionally be used as articles in the News & Notes or on the website.
- To maintain the Legal Hotline telephone number and system.
- To bill us for your fees on a monthly basis and appear for an annual review.
QUALIFICATIONS:
Nebraska REALTORS® Association would request the candidate who has:
- 5 or more years of progressive legal experience
- Strong academic background with a Juris Doctorate degree from an ABA accredited law school
- Active membership in the Nebraska State Bar Association
- Excellent legal understanding of the real estate industry
- Strong verbal and written communication abilities,
- Experience in transactional law with an emphasis on contracts is preferred and some non-profit legal experience is a plus.
- People and project management ability required, with an understanding of the unique issues of a volunteer-driven organization preferred.
- Strong communicator and congenial team player with excellent diplomatic, motivational and teaching skills.
- Ability to handle and manage multiple projects, and meet timelines and deadlines.
- Strong computer literacy on office products required.
